Unparalleled Legal Counsel for Victims of Car and Motorcycle Accidents
Car and motorcycle crashes with injuries and fatalities happen daily in Florida, and the number of victims continues to rise annually. Due to the heavy influx of tourists and the increasing population of year-round residents in the state, roadways are more treacherous for drivers and passengers every year. The most common cause of roadway accidents is driver negligence. Examples are distracted driving, following too closely, failing to yield the right of way, intoxication, unsafe lane changes, speeding, and failing to follow traffic signals and signage.
The aftermath of an automobile or motorcycle crash is overwhelming for a victim dealing with medical bills, lost wages, property damages, and pain and suffering. Sadly, many families are left to deal with catastrophic injuries or the sudden loss of a loved one, knowing that life is forever changed.
Every accident has unique circumstances and deserves to be investigated thoroughly. Car Accident and Motorcycle Accident Cases Differ
PIP is “personal injury protection,” a type of no-fault insurance required for all registered automobiles in Florida. PIP coverage is designed to pay for medical expenses and lost wages of the injured driver and other occupants in the event of an accident, regardless of who is at fault. When medical bills exceed the limits of a victim’s PIP insurance, the victim can file a claim against the at-fault party. The minimum coverage for PIP insurance is $10,000. PIP insurance does not pay for property damages.
In contrast, there is no requirement for PIP insurance for motorcycle drivers. Therefore, riders who have an accident with another vehicle must pursue the other driver for the costs of damages. It is recommended that a motorcyclist carry insurance, as there are many uninsured and underinsured automobile owners in Florida.
While the automotive industry continues to implement improved safety features, injuries and fatalities on the roadways for drivers and passengers in cars remain a severe threat. However, death is much more likely in a motorcycle crash. Without the benefit and protection of the safety features in a car, a motorcyclist directly impacts the roadway and other vehicles in an accident, accounting for a high rate of catastrophic injuries and fatalities.
Liable Parties in an Accident
There are many possible defendants in a car or motorcycle accident claim. Examples are the at-fault driver, the manufacturer of the vehicle or its parts, or even the municipality responsible for maintaining the roadway. An employer may be responsible for an accident through vicarious liability if an employee causes an accident while on the job. A rideshare company such as Uber or Lyft may be accountable if their driver is reckless or negligent while transporting a passenger. In addition, any person listed on the vehicle title may be named in a lawsuit, even if they are not driving the vehicle.
Common Types of Accidents are:
- Head-on Collisions
- Multi-Vehicle Accidents
- Single Vehicle Accidents
- Rollovers
- T-bone Collisions
- Side Impact Accidents
- Rear-End Accidents
